1. About these terms & conditions
These general conditions apply to all communication channels of Kunstwerkt vzw, including publications, social media and our websites kunstwerkt.be and atelierinbeeld.be, referred to hereinafter as "the communication channels".
The websites kunstwerkt.be and atelierinbeeld.be pursue the following objectives:
- The communication channel kunstwerkt.be functions as the central website for all information about initiatives of Kunstwerkt vzw (non-profit organization). In addition, kunstwerkt.be is a platform through which Kunstwerkt vzw enables all visual artists to create, grow, and be seen. On kunstwerkt.be, Kunstwerkt vzw offers the possibility to create an online portfolio, to participate in or organize exhibition opportunities, and to register for sessions, workshops, training courses, and activities for everyone with an interest in visual arts.
- The communication channel atelierinbeeld.be functions as the website for the project Atelier in Beeld, organized by Kunstwerkt vzw.
The communication channels are owned and operated by Kunstwerkt vzw, company number 0474.665.342 with registered address at 9000 Ghent, Nederpolder 2.
By visiting our communication channels and/or using one of our services and/or participating in our competitions or discussion forums, you fully accept all these conditions.
We reserve the right to modify certain provisions of these terms and conditions. In that case, these terms and conditions will apply from the time of publication.
In case one or more points of these terms and conditions should prove to be unenforceable or only partially enforceable, this shall not affect the validity of the remaining provisions.
2. Information on the website
The information we provide ourselves on the communication channels is the result of meticulous research and analysis. Nevertheless, the information is provided and displayed without any kind of guarantee.
The information supplied by third parties, such as banners, buttons, html-pages, photos, videos or blog posts are not the responsibility of Kunstwerkt vzw. Kunstwerkt vzw is not liable for the accuracy, completeness, usefulness, reliability and topicality of the information on the site and for the consequences of any action/decision taken on the basis of the information provided.
Disturbances, interruptions or errors in the electronic delivery of services requested through our communication channels do not under any circumstances give right to any compensation. Kunstwerkt vzw is also not liable for possible viruses, in case these should occur despite the precautions taken on the communication channels. Kunstwerkt vzw expressly reserves the right to change the information on the communication channels at any time. Kunstwerkt vzw cannot be held liable for any damage whatsoever caused by an error and/or negligence committed by employees and/or subcontractors of Kunstwerkt vzw, except in the case of intent or gross negligence.
The communication channels may contain hyperlinks to websites or to web pages of third parties and other parties, or refer to them in any other way. Kunstwerkt vzw has no control over the content or other characteristics of these websites or web pages and is in no case liable for their content or characteristics. The placing of links by Kunstwerkt vzw does not imply in any way an implicit approval of the content of these websites or web pages.
You can place a hyperlink on your own website to Kunstwerkt's homepage. You may also deeplink to specific content on our website(s).
3. Personal data
Kunstwerkt vzw respects the provisions of the Personal Data Protection Act of 30/07/2018 and the Electronic Commerce Act of 11/03/2003, when collecting and processing personal data. By using our services, you declare your agreement with our privacy policy.
4. Intellectual property
The texts, drawings, photographs, films, images, data, content and structure of the databases, software, names, trade and domain names, brands, logos and other components of the communication channels are protected by intellectual rights and belong to Kunstwerkt vzw or third parties. It is not permitted, without prior written consent of Kunstwerkt vzw, to store, reproduce, modify, publish, distribute or transmit the information offered on, or via, these communication channels, free of charge or in return for payment, in a way that violates intellectual property rights. Furthermore, you commit yourself to not use the communication channels in a way that may infringe the rights of a third party such as, but not exclusively, the rights of privacy and intellectual property.
Kunstwerkt vzw wishes to respect the intellectual property rights of the content on its communication channels. We concluded an agreement in this respect with the copyright management company Sabam.
In addition, the following rules apply:
- If you publish material (photos, texts, announcements, etc.) on a communication channel of Kunstwerkt vzw, you give Kunstwerkt vzw free and unlimited permission to distribute this material through its communication channels. You guarantee that you possess all necessary permissions from the right holders (artists, photographers, depicted persons, etc.) and indemnify Kunstwerkt vzw against all claims by third parties, including copyright associations such as Sabam and Sofam.
- It is your sole responsibility to contact, in advance, all individuals who have contributed to the work you wish to publish on the website (including collaborators and any persons depicted in the work).
- Kunstwerkt vzw is not responsible for any material (audiovisual content, photographs, texts, listings, open calls, or works) posted by third parties on its communication channels.
- Do not hesitate to contact us in advance should you have any questions regarding the rights associated with submissions.
- You may withdraw permission to distribute your published material through Kunstwerkt vzw's communication channels at any time, by letter or e-mail. Kunstwerkt vzw will then remove the material from its communication channels as soon as possible.
- If you believe that your rights have been infringed by material posted on our communication channels, you can report this possible infringement at info@kunstwerkt.be. We undertake to investigate your objection and, if necessary, remove the material.
5. Responsibility
You, or if you are a minor, your parents or legal guardian, are responsible for all actions you undertake on the communication channels.
Kunstwerkt vzw endeavours to review your material and information in advance. Kunstwerkt vzw reserves the right to refuse, remove or deny access to the use of these communication channels, as well as to any posts and uploads.
Display, not sale: As an online portfolio and artist platform, the primary purpose of Kunstwerkt’s communication channels is the display of artistic, visual work. Consequently, the platform does not function as a sales platform and Kunstwerkt vzw bears no responsibility for the sale or pricing of works displayed on the platform.
Kunstwerkt vzw may request you to provide your name and email address. These details may be disclosed to police services and judicial authorities if they are conducting an investigation into unlawful behaviour in connection with the use of our communication channels.
You warrant that all information you provide to us is and remains accurate and up to date, and you agree to indemnify and hold us harmless against all claims and demands made by third parties in this regard.
6. Disputes and Applicable Law
These terms and conditions are governed by Belgian law. In the event of a dispute, only the courts of Ghent shall have jurisdiction.
7. Privacy
Kunstwerkt vzw complies with the provisions of the General Data Protection Regulation (GDPR). The full privacy policy can be consulted here.
8. Cookies
We may use a “cookie” during your use of our services. A cookie is a small file sent by an internet server and stored on your computer’s hard drive. A cookie records the website visited and contains certain information relating to that visit.
